New Mexico Registered Agent Requirements for LLCs
Every New Mexico LLC must continuously maintain a registered agent and a registered office in the state. The requirement lives in NMSA 1978, § 53-19-5, applies from the day your Articles of Organization are accepted, and stays in force for the life of the company. It is the one obligation the Secretary of State enforces on LLCs after formation, since New Mexico asks for no annual report.
The Job Itself
The registered agent is the company's fixed, findable point of contact. When someone sues your LLC, the papers go to the agent. When the Secretary of State or another official body needs to reach the entity, the agent's address is where the notice lands. The agent's name and street address sit on the public record, searchable by anyone, which is precisely the point: an LLC that cannot be located cannot be held to account, so the state requires every LLC to be locatable.
Who Qualifies Under § 53-19-5
The statute allows three kinds of agent:
- an individual who is a resident of New Mexico
- a domestic corporation, LLC, or partnership whose place of business is the same as the registered office
- a foreign corporation, LLC, or partnership authorized to transact business in New Mexico, again with a place of business matching the registered office
The registered office must be in New Mexico and may be the same as the company's principal place of business. Filings require street addresses, so a PO box cannot anchor the registered office. Practically, the agent needs to be reachable at that address while business is conducted, because service of process arrives in person and unannounced.

Like all New Mexico business filings it is submitted online through the enterprise portal, and the fee set by NMSA 1978, § 53-19-63(I) is $20. You may see $10 or $22 quoted elsewhere: the first is out of date and the second bundles in a card-processing charge.
